Travel Firoz Blogger (https://travel.firozblogger.com), referred to as “we,” “us,” or “our,” respects the intellectual property rights of others and expects its users to do the same. We are in compliance with the requirements of the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c).
This DMCA Policy outlines the procedure for submitting a notification of alleged copyright infringement, as well as the procedure for submitting a counter-notification if you believe your content was wrongly removed.
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on or through our Service, please submit a DMCA Takedown Notice.
1. Notification of Copyright Infringement (Takedown Notice)
To be effective, your DMCA Takedown Notice must be a written communication provided to our designated Copyright Agent that includes substantially the following:
(a) Identification of the Copyrighted Work: You must identify the copyrighted work that you claim has been infringed. If multiple copyrighted works at a single online site are covered by a single notification, you must provide a representative list of such works at that site.
(b) Identification of the Infringing Material: You must identify the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. You must provide information reasonably sufficient to permit us to locate the material. This includes, at a minimum, the URL of the page(s) where the allegedly infringing material is located.
(c) Contact Information of the Complaining Party: You must provide information reasonably sufficient to permit us to contact you, such as your legal full name, a mailing address, telephone number, and, if available, an email address.
(d) A Statement of Good Faith Belief: You must include the following statement: “I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
(e) A Statement of Accuracy: You must include the following statement: “I swear, under penalty of perjury, that the information in this notification is accurate, and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
(f) Physical or Electronic Signature: The notification must be signed by the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. This can be a physical signature or an electronic signature.
Designated Copyright Agent:
All DMCA Takedown Notices must be submitted to our designated Copyright Agent:
Via Email: [Your Designated DMCA Email Address, e.g., dmca@travel.firozblogger.com] Subject Line: DMCA Takedown Notice
Via Mail: [Your Mailing Address – Optional, but recommended by law]
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material or activity is infringing may be subject to liability for damages.
2. Procedure Upon Receipt of a Valid Takedown Notice
Upon receipt of a valid DMCA Takedown Notice, we will:
- Promptly remove or disable access to the allegedly infringing material.
- Notify the user who posted the material (the “Affected User”) that we have removed or disabled access to their material.
- For repeat infringers, we will take appropriate action, which may include terminating the user’s access to our platform.
3. Counter-Notification Procedure (If Your Content Was Removed)
If you are an Affected User and you believe that your material was removed or disabled as a result of mistake or misidentification of the material, you may send a written Counter-Notification to our Designated Copyright Agent.
To be effective, your Counter-Notification must include substantially the following:
(a) Identification of the Removed Material: You must identify the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or access was disabled.
(b) Contact Information: You must provide your legal full name, mailing address, telephone number, and email address.
(c) A Statement of Good Faith Belief: You must include the following statement: “I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.”
(d) A Statement of Consent to Jurisdiction: You must include the following statement: “I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or [Your City, Your State, Your Country] if my address is outside of the United States), and I will accept service of process from the person who provided the original DMCA notification or an agent of such person.”
(e) Physical or Electronic Signature: The Counter-Notification must be signed by you.
4. Procedure Upon Receipt of a Valid Counter-Notification
Upon receipt of a valid Counter-Notification, we will:
- Promptly provide the original complaining party with a copy of the Counter-Notification.
- Inform the complaining party that we will replace the removed material or cease disabling access to it in ten (10) business days.
- We will replace the removed material or cease disabling access to it not less than ten (10), nor more than fourteen (14), business days following receipt of the Counter-Notification, unless our Designated Copyright Agent first receives notice from the original complaining party that such party has filed an action seeking a court order to restrain the Affected User from engaging in infringing activity relating to the material on our system.
5. Repeat Infringer Policy
